DEVELOPMENT REVIEW BOARD MEETING

MARCH 26, 2008

Board members present: Chris Lekberg, John Peterson, Alisa Cutter, Phyllis Reed, Samantha Stone. Alternate: Phyllis Aitchison

The meeting was called to order at 8:26 pm. The board entered deliberations:

McDonough #4955

Motion by Lekberg/Peterson to uphold the Zoning Administrator's decision to require a Commercial II conditional use permit for #4955 John McDonough at 43 Center St. The appeal is denied. The Board contends that the use at the property is a Commercial II use. The applicant is welcome to apply for a conditional use permit for Commercial II use. Passed unanimously.

Salkins #4963

Motion by Reed/Cutter to approve the application for Joan Salkins #4963 to add an enclosed sunroom and deck on property at 142 Severy Farm Rd., Unit 4, Country Club Townhouses as proposed. Passed unanimously.

Mitchell Subdivision #4960

Motion by Peterson/Cutter to approve #4960 to Landowner Ruth Nichols and Applicant Arthur Mitchell for a subdivision at 66 Lovers Lane to create a fourth lot as presented. Passed unanimously (Reed recused; Aitchison participated)

Mitchell Conditional Use #4962

Motion by Cutter/Aitchison to approve a conditional use permit #4962 with conditions, to allow the operation of manufacturing of wooden furniture, Light Manufacturing use category at 66 Lovers Lane for Arthur Mitchell as proposed. The Board finds the proposed development meets the requirements of Section 305 of the Brandon Zoning Bylaw and is in accordance with the Performance Objectives and Standards (Section VI) of the Brandon Land Use Ordinance. This conditional use permit is approved with the following conditions:

  • Lighting shall be downward and not exceed the lot line
  • The operation will meet all local and state regulations and standards for filtered and recirculated air.
  • Flammable materials will be stored in a safe and regulated manner.
  • All trucks are to be loaded off road and on site.
  • Proper parking has to be established for up to ten employees and two customers.
  • There will be no noise beyond 70 decibels at the lot line.
  • Motion passed unanimously. (Reed recused; Aitchison participated)

    Mitchell Act 250 #4961

    Motion by Aitchison/ Cutter to approve the Act 250 application for Arthur Mitchell for criteria #6, 7, and 10 as presented. Passed unanimously. (Reed recused; Aitchison participated)

    Being no further business, the meeting closed at 8:55 pm.
