BRANDON DEVELOPMENT REVIEW BOARD MEETING AUGUST 27, 2008 Present at the meeting: Chris Lekberg, John Peterson, Samantha Stone, Phyllis Reed, Alisa Cutter. Also present was Charlie Jakiela The meeting opened at 8 pm. Appeal of DRB decision - There was discussion with Charlie Jakiela regarding the appeal to Environmental Court from Melissa and Tim Gibbud, landowner; Specialized Community Care, applicant (permits #4989 & 4990). The Town is making an appearance. Zoning Administrator - Charlie said that when there are cases before the DRB which do not involve an appeal of the z.a.'s decision, State law and VLCT recognize that there is a role for the zoning administrator to help with jurisdictional questions. He said he could be of help to the DRB during deliberations to relate one part of the ordinance to another or to relate to specific provisions. Charlie said it is up to the Board to decide if they would want his presence during deliberations. The Board will discuss this and let Charlie know. Doug Bailey permit #4747 - Charlie Jakiela said there are questions from a proposed buyer regarding the size of a subdivided lot created by Doug Bailey under permit #4747. He said one of the Findings of Fact in the DRB's decision stated that the lots would be larger than three acres. He said the surveyor is showing the lot to be 3.002 acres. Charlie said the proposed buyer would like Board clarification that they would consider a 3.002 acre lot to be large enough. The Board was in agreement that the lot size would be large enough to satisfy the subdivision permit. Upcoming appeal hearing - Janet said there is an appeal hearing due to be warned for the September meeting. An adjoining landowner is appealing a permit that the zoning administrator issued. The appellant's lawyer has asked for this to be continued until November. Janet left a message for the lawyer indicating that they only way the hearing could be continued would be if the lawyer or appellant received approval in writing from the permit-holder. Charlie Jakiela left the meeting at 8:30 pm and the Board entered deliberations. Deliberations #5041 Bill and Shelley Brown Motion by Cutter/Stone to approve the conditional use #5041 for Applicant and Landowner William and Shelley Brown to convert the currently vacant second floor space into a two bedroom dwelling unit. Motion passed unanimously. #5027 Gibbud Appeal of Hopkins Motion by Stone/Reed to uphold the zoning adminstrator's decision to grant permit #5027 to Seth and Olya Hopkins to construct a parking lot adjacent to the Churchill House Inn and deny the appeal by Tim and Melissa Gibbud.
