BRANDON DEVELOPMENT REVIEW BOARD MEETING OCTOBER 22, 2008 Present at the meeting: Chris Lekberg, Phyllis Reed, and Phyllis Aitchison. The meeting opened at 7:30 pm. Deliberations #5057 DeBisschop Motion by Aitchison/Reed to approve the variance #5057 for Applicant and Landowner Matthew and Courtney DeBisschop to subdivide one parcel into two parcels. The parcel is .22 acres and it contains two homes. The parcel is in the Neighborhood Residential district which requires a 20' setback from other lot lines and a minimum one-quarter acre of land (if on municipal sewer) per parcel. The Board reviewed the five criteria. They were not able to vote in the affirmative for criterion #3 & 5 1) This is an existing small lot with two existing grandfathered homes. 2) This is already non-conforming. 3) This hardship is being created by the appellant. 4) This is a residential use in a neighborhood residential zone. 5) This variance is not being authorized. Per Section 108 of the Brandon Land Use Ordinance, the Board does not feel they are empowered to grant a variance which would reduce a lot and therefore create a lot less than the minimum lot area required and in which existing structures did not meet required setbacks. Motion failed on a vote of 0 (yes) to 3 (no)
#5059 McKernon Group / Sawyers Inn, Inc DBA Lilac Inn Motion by Reed / Aitchison to approve the conditional use #5059 for Applicant McKernon Group and Landowner Sawyers Inn, Inc. DBA Lilac Inn to construct a 30' x 60' building consisting of four <one-bedroom and one bathroom> dwelling units which will be located toward the south end of the lot and rehabilitate the existing back parking lot for additional parking. This use is Commercial I. This parcel is in the Neighborhood Residential district and requires a Conditional Use Permit under Section 304 of the Brandon Land Use Ordinance. This request voids permit #5018 issued for the addition of three buildings behind the Lilac Inn.
