BRANDON DEVELOPMENT REVIEW BOARD

MARCH 11, 2009

MEETING

Board members present: Alisa Cutter, Phyllis Reed, Phyllis Aitchison, Sam Stone

The meeting opened at 6:50 pm.

Deliberations #5028

Bunting appeal of Leavitt

Motion by Stone/Reed to overturn the Zoning Administrator's permit #5028 to Allan M. Leavitt to develop a private driveway approximately 750' in length to access the northerly portion of the property and grant the appeal to Nancy B. Bunting. Based upon testimony and evidence presented, the Board contends that the Zoning Administrator did not act appropriately in issuing the permit #5028.

Motion passed unanimously.

Board Recommendations.

The Board is amenable to the applicant resubmitting an application with more evidence. Specifically, the criteria in Section 607(b) should be fulfilled.

The applicant is recommended to fulfill all other criteria of the Brandon Land Use Ordinance.

There was testimony presented at the hearing stating that this application was "not for keeping horses." However, since the written application stated that there might involve keeping horses, the applicant needs to adhere to the criteria in Section 619 of the Brandon Land Use Ordinance upon re-application.

Being no further business, the meeting closed at 7:37 pm
