BRANDON DEVELOPMENT REVIEW BOARD MEETING JULY 22, 2009 Board members present: Chris Lekberg, Alisa Cutter, Phyllis Reed, Phyllis Aitchison The meeting was opened at 7:30 pm . Also present: Tina Wiles The Board acknowledged receipt of the Neshobe PUD Final Plan Application dated July 13, 2009. There was discussion about the application. Ms. Wiles said she knows the applicant has had discussions with the right people about water and sewer but no fees have been paid and there are no formal agreements. The plans show access points on to Route 7 and Steinberg and Champlain Streets. They do not have access approvals from the state or town. There will be a wetlands impact and there is no paperwork from that state office. Nor is there paperwork from the state Stormwater office. Ms. Wiles said some of the lots have been reconfigured. There was discussion about lot 68 in OMYA's right of way. Ms. Wiles said she believes the applicant have applied for an Act 250 permit simultaneously with the town permit but she has not received any paperwork from that office. They are requesting local Act 250 review at this time. It will be warned for the August meeting. The application has several waivers requested. One is for agricultural practices in the HDMU district; one for the farm stand and one for dimensional requirements. The applicants have not yet approached the town regarding taking over roads. Ms. Wiles will write a letter to the applicant telling them that in order for the Board to consider the application ready for final review, they will need to have all agreements with the town in place. In addition, the Board strongly recommended that the applicant not request final review until all state permits are received. Tina Wiles left the meeting at 8:00 pm Deliberations Wortman #5121 Motion by Aitchison / Reed to approve application #5121 for Clayton J. Wortman, Jr. and Judy L Carlson to install a three (3) bedroom, one-story, 28' x 44' single family home on a property located in an area designated by the National Flood Insurance Program as being in an area designated as "Special Flood Hazard Areas Subject to Inundation by the 1% Annual Chance Flood" with a portion in an area noted as being in Zone X, an area determined to be outside the 0.2% annual chance floodplain (NFIP Panel 50021C 0045D dated August 28, 2008) with the following conditions: The applicant will abide by all mandates outlined in the letter dated July 2, 2009 from Rebecca Pfeiffer, Environmental Analyst, River Management Program, State of Vermont. The applicant will abide by all mandates outlined in the letter dated July 2, 2009 from Mic Metz, District Wetland Ecologist, State of Vermont. The lowest floor, including any crawlspace or basement, will be elevated to or above the base flood elevation of 457.9' The house will be outside any 50-foot buffer zone to the Class Two wetland. Passed unanimously.
McCullough #5135 Motion by Cutter/ Aitchison to accept application #5135 for Applicant: Adam McCullough / Landowner: McCullough Bros., Inc. and approve local Act 250 review to construct a 24' by 90' by 12' Pole Barn for storing business equipment. No water and/or wastewater services. Passed unanimously. Being no further business, the meeting adjourned at 8:15 pm Respectfully submitted
