ORDINANCE ESTABLISHING PROVISIONS FOR TEMPORARY SIGNS AND MERCHANDISE DISPLAYS
IN THE CENTRAL BUSINESS DISTRICT SIDEWALK SECTION
I:
AUTHORITY
This ordinance is adopted pursuant to the authority of 24 VSA 2291(9). SECTION
II:
MERCHANDISE DISPLAYS
The temporary display of merchandise on the sidewalk in the "Central
Business District" as defined in the Brandon Land Use Ordinance shall be
allowed in front of and adjacent to the front wall of a merchant's place of
business upon the condition that a minimum eight (8) foot wide passage be
maintained for pedestrian traffic at all times along the sidewalk. The eight foot width shall begin at the curb or the inside
edge of the tree/planter box, whichever is closer to the building. SECTION
III:
TEMPORARY SIGNS
Temporary signs shall be permitted within the "Central Business
District" provided the signs are placed so as to allow for the eight foot
pedestrian passage along the sidewalk as described in Section I. Temporary signs shall not exceed the following size limit:
maximum four (4) feet in height; maximum
(2) feet in width. All
temporary signs shall be placed in front of the merchant's place of business and
located closest to the curb or against the building.
Each business shall be limited to the display of one temporary sign. SECTION
IV:
OFF-PREMISE SIGNS Off-premise
signs are prohibited. Off-premise
are those which are not within the boundaries of the property frontage extended
through the sidewalk. SECTION
V:
EXEMPTIONS
Any merchandise displayed during the Brandon Chamber of Commerce
sanctioned Sidewalk Sale Days shall be exempt from this Ordinance. SECTION
VI:
PENALTIES
Any persons, principles, agents, corporations or other entities violating
the provisions of this article shall be fined $50.00 for each offense; and a
separate offense shall be deemed committed on each day in which the violation
continues after notification of violation. SECTION
VII:
EFFECT This act
shall take effect sixty (60) days after passage by the Select board at a duly
noted hearing, which date will be hereunder indicated on the face of this
ordinance. Approved
